The Committee considered the report regarding the revisions to the Licensing Act 2003 policy. The Committee noted the proposed changes to the current policy taking into consideration any legislative changes, revisions to guidance or relevant case law that have occurred since the current policy was adopted in 2021. Officers have collaborated with colleagues in the Four Counties Licensing Forum [Carmarthenshire, Ceredigion, Pembrokeshire and Powys County Councils] and so there is consistency in respect of policy and licensing conditions across these councils. Comment was made that reference in the policy to other agencies need to be checked as some no longer exist or have changed their names. In response to a question regarding the UK government’s consulting on changes in the licensing laws, the Licensing Officer advised that the policy refers to the fact that any future legislative changes will be taken into account and agreed that this reference to this will be emphasised further in the policy. In respect of vaping shops the Committee noted that these come under the remit of Trading Standards. The Licensing Officer in response to a question advised that the sale of energy drinks do not come under licencing legislation. However, many retailers have their own policies not allowing the sale of such drinks to under 16s and limit the number of drinks which can be bought at any one time. It was moved and seconded to approve the revised Licensing Act 2003 policy set out at Annex A for consultation subject to the minor changes relating to references to other agencies. Following consultation consider any relevant comments at a future meeting and to present a final policy to Full Council for approval and publication in January 2026. Resolved to approve the revised Licensing Act 2003 policy set out at Annex A for consultation, subject to the minor changes relating to references to other agencies. Following consultation consider any relevant comments at a future meeting and to present a final policy to Full Council for approval and publication in January 2026.
The Committee noted the minutes of the following Sub-Committee meetings: 05/03/2025, 01/04/2025 and 16/07/2025.
Councillors must say when they have a personal link to something being discussed, such as a job, a property or a family member. A prejudicial interest is one strong enough that the councillor usually leaves the room and takes no part.
Declarations are read from the minutes once they are published.
