Premises – The Radnor Arms, New Radnor Applicant – Mr Martin Lewis The Licensing Officer advised that the reason for the referral to the Sub-Committee was that the premises did not meet the public safety licensing objectives and the Fire Authority had not agreed to the licence being issued. The Fire Authority had advised the applicant of a range of work to be completed at the premises. The Fire Authority had contacted the Licensing Authority yesterday indicating that the required works had been completed to its satisfaction. It therefore withdrew its objections to the license being issued. The Licensing Officer advised that as this was the only objector, she had spoken with the Fire Authority and applicant and advised that the licence could now be issued and there was nothing for the Sub-Committee to consider.

In attendance: Licence Holder – PL/01/25 Mr R Bowen, Dyfed/Powys Police Licensing Officer. The Licensing Officer presented the licensing authority’s position as outlined in the report [copy filed with the signed minutes]. She acknowledged there might be issues between the parties involved but that the actions of PL/01/25 was not those expected of a personal licence holder. She was recommending that the personal licence should be revoked. In response to a question she advised that the Sub-Committee had a number of options namely: • Take no further action. • Issue a warning letter. • Suspend the personal licence for a period not exceeding 6 months. • Revoke the personal licence. The Sub-Committee watched the CCTV footage of the incident in August 2024. Mr Bowen referred to the Police report. He advised that the incident in August 2024 led to a prosecution and the Police supports the revocation of the personal licence. He advised that a personal licence holder and Designated Premises Supervisor [DPS] were important roles. He considers that PL/01/25 behaved in a manner far beyond reasonable conduct. Mr Bowen also advised that the Police attended a call regarding disorder in June 2023. As a result, he visited PL/01/25 and reminded him of his position as a personal licence holder and the inappropriate level of force used in dealing with the incident. In response to a question from the Sub-Committee Mr Bowen referred to his report regarding other incidents He advised that the Police had recorded a couple of incidents since August 2024. An incident in December 2024 which related to a report of damage to PL/01/25’s car resulted in no further action being taken, as there was no evidence as to who had caused the damage. The second incident related to threats made by an individual towards PL/01/25 in December 2024. The Police had decided to charge the suspect with public disorder but this had not yet been done. PL/01/25 explained the background to the incident in August 2024, which he had set out in his written representations. He advised that the victim of the assault was constantly a problem. He advised that 18 calls had been made to the Police and nothing had been done, he disagreed that only two calls had been made. He admitted that he had used excessive force. He also explained what happened at the incident in June 2023. Iin response to a question Mr Bowen advised that he had reviewed the Police data system and the only incidents flagged were those referred to in his report. In summary, the Licensing Team Manager advised that although there were mitigating circumstances to the incident in August 2024 this was not the first occasion where an incident occurred at the premises at which PL/01/25 was the DPS. In light of this she recommended that the Sub-Committee revokes the personal licence. PL/01/25 made a summary statement and advised if the licence was revoked they would be given time to allow someone else to take their place at the premises. All parties confirmed that they were satisfied that they had been able to make their representations. The Sub-Committee withdrew to consider, in private, the application and the evidence they had heard, with the support of the Clerk. On their return the Chair announced their decision. In reaching the decision members took into account the relevant written and verbal representations. RESOLVED Reason for decision That the personal licence held by PL/01/25 be revoked. To uphold the licensing objectives within the Licensing Act 2003. The Clerk to the Sub-Committee advised that she would confirm the decision in writing and reminded PL/01/25 of their right to appeal. The Chair thanked all for attending.
