Response by the Cabinet Member: Annwyl Gynghorydd Elwyn Diolch am eich cais am wybodaeth am ymateb Gofal Cymdeithasol Oedolion i’r honiadau o fwlio ac aflonyddu a godwyd gan Unison yn erbyn Shaw Healthcare yn llythyr agored yr undeb ar 11 Ebrill. Isod, mae gwybodaeth am broses rheoli newid Shaw Healthcare, a’n ymateb hyd yn hyn. Shaw Healthcare yw’r darparwr gwasanaethau sydd wedi’i gomisiynu i redeg deuddeg cartref gofal preswyl i bobl hŷn ac un cyfleuster ail-alluogi gan Gyngor Sir Powys. Mae’r gwaith o redeg y cartrefi sy’n eiddo i Gyngor Sir Powys wedi cael ei gomisiynu i ddarparwyr allanol ers 1999. Cafodd cyflogaeth holl staff y Cyngor a oedd yn gweithio yn y cartrefi yn 1999 ei throsglwyddo i BUPA (y darparwr gwasanaethau a oedd newydd ei gomisiynu bryd hynny) o dan reoliadau TUPE. Wedi hynny, cafodd cyflogaeth staff y cartrefi ei throsglwyddo o BUPA i Shaw Healthcare yn 2019. Mae'r contract presennol gyda Shaw Healthcare wedi bod yn ei le ers mis Mai 2019 ac mae'n dod i ben ym mis Mai 2024. Ar hyn o bryd, mae gwaith yn cael ei wneud i asesu'r opsiynau ar gyfer ail-gomisiynu gwasanaethau cartrefi gofal Powys yn y dyfodol. Mae contract y Cyngor gyda Shaw Healthcare yn gosod y cyfrifoldeb am staffio a rhedeg y cartrefi ar y darparwr sydd wedi’i gomisiynu i ddarparu gwasanaethau, a gweithwyr Shaw Healthcare yw’r staff sy’n gweithio yn yr 13 lleoliad. Mae'r cyfrifoldeb am weithredu a rheoli unrhyw newidiadau i delerau ac amodau cyflogaeth staff yn nwylo Shaw Healthcare. O'r herwydd, yn unol â pharamedrau ein cyfrifoldeb fel yr awdurdod comisiynu, cafodd y Cyngor ei hysbysu gan Shaw Healthcare am fwriad Shaw Healthcare i wneud newidiadau i gyflog, telerau ac amodau ei staff ond ni ymgynghorwyd â’r Cyngor. Ni wnaeth y cwmni ymgynghori a ni o ran y camau yr oedd yn bwriadu ei gymryd i reoli’r broses newid ac ni chafwyd gwahoddiad i roi mewnbwn o ran ei gynlluniau ar gyfer y camau hynny. Briffiwyd swyddogion y cyngor gan Shaw Healthcare ar y dechrau am ei fwriad i wneud newidiadau i gyflogau a thelerau ac amodau ac maen nhw wedi cael eu diweddaru gan y cwmni drwy gydol y broses. Rydym wedi monitro'r broses yn agos trwyddi draw ac yn parhau i wneud hynny. Fe wnaeth uwch swyddogion y Cyngor gwrdd â chynrychiolwyr y cwmni pan awgrymodd y byddai'n gweithredu ymateb 'diswyddo ac ailgyflogi' yn achosion staff oedd wedi gwrthod derbyn y cytundebau newydd. Fe wnaeth y swyddogion annog Shaw Healthcare i gymryd agwedd bwyllog ac i roi'r gorau neu ar ei waethaf gohirio gymryd y cam hwnnw. Yn ehangach, mae'r contract gyda Shaw Healthcare yn destun monitro a rheoli contractau cadarn gan y Cyngor, gydag ansawdd y gofal a ddarperir i breswylwyr cartrefi fel ei brif ffocws. Mae hyn yn cynnwys y canlynol sy’n digwydd yn rheolaidd: · cyfarfodydd rheoli contract gyda'r darparwr, · archwiliadau monitro’r cartrefi o dan y contract, · deialog gyda Shaw Healthcare ynghylch materion gweithredol cyffredinol o fewn cartrefi unigol neu'n gysylltiedig â phreswylwyr unigol. Mae’r mesurau hyn yn eu lle i sicrhau'r Cyngor bod y darparwr o’r gwasanaethau sydd wedi’u contractio yn darparu'r lefel briodol o ofal a chymorth wedi’i gomisiynu, ac er nad ydym wedi cefnogi proses rheoli newid Shaw Healthcare o ran gyflog a thelerau ac amodau ei staff, ac wedi gwneud ein pryderon yn glir ac yn eithaf cadarn am ddefnydd y cwmni o'r ymateb 'diswyddo ac ailgyflogi', rydym hefyd wedi gofyn am sicrwydd gan y cwmni am sut mae'n cefnogi'r holl staff sydd wedi’u heffeithio gan y broses newid, a sicrhau nad yw'r broses yn cael unrhyw effaith andwyol ar ansawdd y gofal yn ei gartrefi a lles ei breswylwyr. Mae'r Cyngor wedi ymrwymo i gefnogi gwell cyfraddau cyflog i weithlu cartrefi gofal. Mae cyfraddau'r ffioedd a delir gan y Cyngor i Shaw Healthcare (sy'n gyffredin â'n cyfraddau ffioedd i holl ddarparwyr cartrefi gofal) yn cynnwys elfen i ariannu talu’r Cyflog Byw Gwirioneddol i staff gofal sy'n gweithio o fewn y cartrefi gofal, yn unol â gofynion Llywodraeth Cymru. Ymhellach i hyn, rydym wedi cynyddu'r arian sy’n cael ei dalu fel y gellir talu’r Cyflog Byw Gwirioneddol i'r holl staff sy'n gweithio yn y cartrefi, ac nid y rhai sy'n darparu gofal uniongyrchol yn unig. Gobeithio bod yr uchod yn ateb eich prif bryderon. Dear Cllr Elwyn Thank you for seeking information about Adult Social Care's response to the allegations of bullying and harassment raised by Unison against Shaw Healthcare in the union's open letter on 11th April. Please find information about Shaw Healthcare's management of change process, and our response to date, below. Shaw Healthcare is the commissioned service provider for the operation of the twelve older people's residential care homes and one reablement facility owned by Powys County Council. The operation of the homes owned by PCC has been commissioned with external providers since 1999. All Council staff working in the homes in 1999 had their employment transferred to BUPA (the service provider newly commissioned at that time) under TUPE regulations. The homes’ staff subsequently had their employment transferred from BUPA to Shaw Healthcare in 2019. The current contract with Shaw Healthcare has been in place since May 2019 and expires in May 2024. Work is currently taking place to assess options for the future re-commissioning of the Powys care homes service. The Council’s contract with Shaw Healthcare places responsibility for the staffing and operation of the homes upon the commissioned service provider, and the staff working in the 13 settings are the employees of Shaw Healthcare. The responsibility for implementing and managing any changes to staff's terms and conditions of employment lies with Shaw Healthcare. As such, in line with the parameters of our responsibility as the commissioning authority, the Council was briefed by Shaw Healthcare about Shaw Healthcare's intention to make changes to its staff's pay, terms and conditions but not consulted. We were not consulted by the company with respect to the actions it proposed to take to manage the change process nor invited to input into its planning of those actions. Council officers were briefed by Shaw Healthcare initially about its intention to make changes to pay and terms and conditions and have been updated by the company throughout the process. We have monitored the process closely throughout and continue to do so. Senior Council officers met with representatives of the company when it suggested that it would be implementing a ‘dismiss and re-engage’ response in the cases of staff who had declined to accept the new contracts. The officers encouraged Shaw Healthcare to take a measured approach and to abandon or at worst defer taking that step. More widely, the contract with Shaw Healthcare is subject to robust contract monitoring and management by the Council, which has as its primary focus the quality of care provided to the homes’ residents. This includes regular: • contract management meetings with the provider, • contract monitoring inspections of the homes, • dialogue with Shaw Healthcare regarding general operational issues within individual homes or concerning individual residents. These measures are taken to assure the Council that the contracted service provider is providing the appropriate level of commissioned care and support, and whilst we have not supported Shaw Healthcare’s management of the change process in relation to its staff's pay and terms and conditions, and have set out in quite robust terms our concerns about the company's use of the 'dismiss and re-engage' response, we have also sought assurance as to how the company is supporting all affected staff through the change process, and ensuring that the process has no adverse effect on the quality of care in its homes and the wellbeing of its residents. The Council is committed to supporting improved wage rates for the care home workforce. The fee rates paid by the Council to Shaw Healthcare (in common with our fee rates to all care home providers) include an element to fund the payment of the Real Living Wage to care staff working within the care homes, in line with Welsh Government requirements. Further than this however, we have increased the monies paid to enable the Real Living Wage to be paid to all staff working in the homes, not just those providing direct care. I hope that the above answers your key concerns.
Councillors must say when they have a personal link to something being discussed, such as a job, a property or a family member. A prejudicial interest is one strong enough that the councillor usually leaves the room and takes no part.
