Premises – The Buck Hotel, Caerws Applicant – Mr Clive Whitehead Interested parties – Dyfed Powys Police represented by PC Rod Bowen (Police Licensing Officer) The Licensing Officer presented the licensing authority’s position as outlined in the report [copy filed with the signed minutes]. The Licensing Officer informed the Sub-Committee that Mr Whitehead's personal licence had been suspended for a period of three months by Shropshire Council. As a consequence, he had been required to vary the Designated Premises Supervisor (DPS) for the Buck Hotel and appoint another individual to that role. The Licensing Officer emphasised that the purpose of the hearing was to consider the review of the Buck Hotel's premises licence. The Police Licensing Officer stated that Mr Whitehead had failed to promote the licensing objectives and raised concerns regarding the operation and management of the premises, including CCTV provisions, the Fire Safety report and the handling of incidents. The Panel sought clarification regarding the operation of the CCTV system on the night of an incident, and the fire safety matters referred to in the report. It was noted by the Police Licensing Officer that the CCTV system had since been repaired and that no further requests for footage had been made, Clarification was also sought regarding the retention period for CCTV recordings. In relation to fire safety, it was noted that the Fire Service had not undertaken a follow-up visit to confirm compliance with the actions previously identified. Mr Whitehead advised that he had recently been in contact with the Fire Service and that a further inspection was being arranged. The Sub-Committee withdrew to consider, in private, the application and the evidence they had heard, with the support of the Clerk. On their return the Chair announced their decision. In reaching the decision members took into account the relevant written and verbal representations. Councillors must say when they have a personal link to something being discussed, such as a job, a property or a family member. A prejudicial interest is one strong enough that the councillor usually leaves the room and takes no part.
