Moved by Councillor David Edwards; Seconded by Ms Maggie Hughes. The vote, undertaken by way of a roll call was carried. For the Motion: Mr Nadeem Ahmad, Councillor Mark Carter, Councillor David Edwards, Ms Maggie Hughes, Ms Moira Saunders, Councillor Sarah Snow and Mr Nick Watt [7] There were no votes against or abstentions. DECISION That the public be excluded from the meeting for the following item of business in accordance with Section 100A (4) of the Local Government Act 1972 as it involves the likely disclosure of exempt information as defined in Paragraphs 12 and 13 of Part 4 of Schedule 12A to the Act; and that the public interest in maintaining the exemption outweighs the public interest in disclosing the information.
The Committee convened in private session under the terms of Paragraphs 12 and 13 of Part 4 of Schedule 12A to the Local Government Act 1972 to consider this item of business. The Committee considered a report by the Public Services Ombudsman for Wales on the investigation into an alleged breach of the Members’ Code of Conduct. The Committee noted that the finding of the Ombudsman under Section 69 of the Local Government Act 2000 was that the report should be referred to the Monitoring Officer, for consideration by the Standards Committee. In accordance with the Local Government Investigations (Functions of Monitoring Officers and Standards Committee) (Wales) Regulations 2001, the Committee was required to determine in the first instance whether there was no evidence of failure to comply with the Code of Conduct; or whether any person subject to investigation should be given the opportunity to make representations before any determination was made. In considering the Ombudsman’s report, the Committee determined that the County Councillor should be given the opportunity to make either oral or written representations to the Committee. The Committee then reconvened in public to present the decision. Moved by Ms Maggie Hughes; Seconded by Ms Moira Saunders. The vote, undertaken by way of a roll call, was carried. DECISION That the Councillor should be given the opportunity to make representations, either orally or in writing, in respect of the findings of the investigation and any allegation that the Councillor has failed, or may have failed, to comply with the Code.
Councillors must say when they have a personal link to something being discussed, such as a job, a property or a family member. A prejudicial interest is one strong enough that the councillor usually leaves the room and takes no part.
Declarations are read from the minutes once they are published.
Lists the council's current councillors only. Co-opted members, officers and former councillors aren't shown.
