Decision as recorded
RESOLVED That AA’s Combined Hackney Carriage/Private Hire Vehicle Drivers Licence be suspended for three months with immediate effect.
Having convened in private session under the terms of Section 100A(4) of the Local Government Act 1972, the Sub-Committee considered the report of the Lead Licensing Officer regarding the application for a combined Hackney Carriage/Private Hire Vehicle driver’s licence by AA. The applicant and their representative were present at the Hearing and were provided the opportunity to present their case to the Sub-Committee and to respond to questions from Members of the Sub-Committee The Solicitor outlined the options available for the Sub-Committee to decide on the application. The Sub-Committee then retired to undertake its consideration of the representations submitted. The Sub-Committee then resumed, and the Chair announced the decision. DECISION The Sub-Committee has taken into account the representations by and on behalf of the driver. The Sub-Committee is satisfied that the driver is genuinely remorseful and also accepts what the driver has stated about it being a stupid mistake. The Sub-Committee notes that for the two incidents in issue, on neither occasion did the driver notify the Authority of either penalty, in breach of conditions applicable to drivers. However, the Sub-Committee cannot ignore what it has seen and is satisfied that the more recent incident is so serious that it cannot be ignored. The consequences of the driver’s irresponsible actions could easily have been far more serious. It was inappropriate action by a professional driver. In line with the policies to which the Sub-Committee is subject, and from which there is no exceptional reason to depart, the decision is therefore to suspend the driver’s dual licence for a period of three months under Section 61(1)(b) of the Local Government (Miscellaneous Provisions) Act 1976, being under any other reasonable cause, as the driver’s behaviour fell well below the standard expected. Public safety is the paramount consideration and it is considered necessary for this sanction to be imposed as the Sub-Committee can in no way condone the driver’s behaviour. As the suspension is made in the interests of public safety, the suspension is to have immediate effect, irrespective of any appeal made by the driver. The vote, undertaken by way of a show of hands, was carried. RESOLVED That AA’s Combined Hackney Carriage/Private Hire Vehicle Drivers Licence be suspended for three months with immediate effect.
Councillors must say when they have a personal link to something being discussed, such as a job, a property or a family member. A prejudicial interest is one strong enough that the councillor usually leaves the room and takes no part.
