The decisions as the council's minutes record them. A plain-language summary follows once it has been written.
RESOLVED That Councillor Mark Carter be elected as Chair for the meeting.
RESOLVED That in accordance with Section 100A(4) of the Local Government Act 1972, the public be excluded from the Meeting for consideration of the current item of business on the grounds that it involves the likely disclosure of exempt information under Schedule 12A to the Act. The Sub-Committee then retired to undertake its consideration of the representations submitted. The Sub-Committee then resumed, and the Chair presented the decision. DECISION The decision read out by the Chair at the hearing was: The Sub-Committee has listened to the evidence submitted by both the Officers and the taxi driver and have decided to revoke the combined licence held by the driver on the grounds of public safety. The Sub-Committee suggests that the driver does not reapply for a combined licence until 12 months have elapsed. A full decision will be published within 7 days to all parties. the driver is reminded that he is able to appeal this decision at a Magistrates court within 21 days of receiving the full decision but, as the revocation is on the grounds of public safety, the taxi driver must not drive a hackney carriage until the appeal is heard and successful. The driver is still able to drive a private car. The reasons for the decision are as follows. The Sub-Committee considers that it must follow its Policy on the treatment of convictions and suitability criteria for drivers, the relevant parts of which state that breaches of conditions (unacceptable behaviour rather than an offence), as has happened in this case, including unacceptable behaviour whilst driving a hackney carriage, or concerning the use of a hackney carriage or private hire vehicle, will be viewed as aggravating features. In addition there was use of a private unlicensed vehicle for contract work. There are in the Sub-Committee’s view little or no mitigating factors that have been put forward that could be used to depart from its Policies. Although not a criminal conviction, driving a hackney carriage vehicle with no road tax can be and is taken into account by the Sub-Committee. Drivers are professionals responsible for carrying the public, in this case a vulnerable person. This is considered to be a serious matter. Section 61(1)(b) of the Local Government (Miscellaneous Provisions) Act 1976 allows for the suspension or revocation of a driver’s licence under any other reasonable cause, which is the subsection appropriate in this case. The Sub-Committee does not consider the driver to be a fit and proper, or safe and suitable, person to continue to hold a Joint Hackney Carriage and Private Hire Driver’s Licence. The overriding consideration must be the safety and protection of the public. For the avoidance of any doubt, as the revocation is on the ground of public safety, the revocation is of immediate effect irrespective of any appeal that may be lodged. The vote, undertaken by way of a show of hands, was carried. RESOLVED That the combined licence held by the taxi driver be revoked with immediate effect.
