The decisions as the council's minutes record them. A plain-language summary follows once it has been written.
RESOLVED That the application be approved.
RESOLVED That in accordance with Section 100A(4) of the Local Government Act 1972, the public be excluded from the Meeting for consideration of the current item of business on the grounds that it involves the likely disclosure of exempt information under Schedule 12A to the Act. The Sub-Committee then retired to undertake its consideration of the representations submitted. The Sub-Committee then resumed and the Chair presented the decision. DECISION The Sub-Committee has carefully considered all representations made before it from all parties, both written and spoken. The Sub-Committee is tasked with deciding whether the applicant is a fit and proper person to continue to hold a licence. The Sub-Committee in deciding this has as its primary consideration public safety. The Sub-Committee has taken into account all matters pertaining to the applicant which are before it. Having regard to the relevant sections of the Council’s adopted Guidance on Determining the Suitability of Licensees, and its own Policy, it is well within the powers of the Sub-Committee to act so as to revoke the driver’s licence with immediate effect. There has now been a conviction following the imposition of a previous court sanction which the Sub-Committee treats very seriously. It is not considered that it would be appropriate to take no action against the driver’s licence. The Sub-Committee’s primary consideration is public safety and the Sub-Committee considers that a suspension of the driver’s hackney carriage driver’s licence is an appropriate sanction for the driver to realise that the driver cannot continue to act in breach of a court order without there being consequences. The Sub-Committee considers that the appropriate length of the suspension is for 3 months. The driver should realise that this is of immediate effect and that the driver should not drive a hackney carriage at all during this 3 month period. Whilst not part of the decision, the driver is warned of the likely sanction if the driver does drive as a taxi driver in the period of suspension or breaches the terms of the court order leading the driver to appear before a future sub-committee. To clarify, this applies to the driver’s hackney carriage driver’s licence, and does not mean that the driver cannot continue to drive a private car. The vote, undertaken by way of a show of hands, was carried RESOLVED That the Taxi/Hackney Carriage Licence be suspended for a period of three months.
RESOLVED That in accordance with Section 100A(4) of the Local Government Act 1972, the public be excluded from the Meeting for consideration of the current item of business on the grounds that it involves the likely disclosure of exempt information under Schedule 12A to the Act. The Sub-Committee then retired to undertake its consideration of the matter and the representations submitted. The Sub-Committee then resumed and the Chair presented the decision. DECISION The Sub-Committee accepts what the applicant has stated as far as the 2 issues before it is concerned. This has been largely verified by the Police Licensing Officer. The Sub-Committee accepts the applicant’s contrition and that the actions were genuine mistakes. The Sub-Committee is satisfied that the applicant is aware of the consequences if there are any more similar motoring issues as far as points on the applicant’s driving licence are concerned and the impact of any more points as far as taxi licensing is concerned. The Sub-Committee’s main consideration is that of public safety, which given the circumstances as explained is not now an issue. On the basis that the applicant has completed all other aspects of the application process, the Sub-Committee is satisfied that the applicant is a fit and proper person to hold a licence and the application is granted. The vote, undertaken by way of a show of hands, was carried. RESOLVED That the application be granted.

Councillors must say when they have a personal link to something being discussed, such as a job, a property or a family member. A prejudicial interest is one strong enough that the councillor usually leaves the room and takes no part.
