RESOLVED That a Working Group be established consisting of all the Members of the Constitutional Review Committee to look at aspects of the Constitution, to include, but not confined to, the matters set out in the report.
The Committee considered a report by the Head of Law and Governance / Monitoring Officer which outlined a number of Constitutional matters that needed to be reviewed and reconsidered, via a Working Group. The Head of Law and Governance / Monitoring Officer introduced the report and highlighted the matters for review, as follows: • The budget-setting process • The Reserve List Protocol • Approval of the Statement of Accounts • Access to and speaking at meetings She explained that the Working Group required a quorum of at least four Members, and that recommendations made by the Working Group would be brought to a meeting of the Constitutional Review Committee, and subsequently to Council. The Committee then raised the following points: • Councillor Alan Dennison wished to establish whether the whole Committee would be a Member of the Working Group, or just a selection of Members. He believed that either would be suitable. • Councillor Pat Davies believed that the informal nature of previous Working Group meetings worked well. She asked whether some background information could be given, for the benefit of members of the public, in relation to the four matters for review. In response, the Head of Law and Governance / Monitoring Officer explained that there were some concerns regarding the budget setting process last year, specifically in relation to last minute alternative budgets. In regards to the Reserve List Protocol, she highlighted that a Member had been placed on a meeting as a Reserve halfway through a meeting. She explained that the correct approval process needed to be established in regards to the Statement of Accounts. She also stated that Councillor Huw Murphy had raised an issue in relation to access to speaking at meetings, which related to a Member speaking at a meeting without advance notice. • The Chair explained that he had raised the issue in regards to the Reserve List Protocol and had discussed it with the Head of Democratic Services to see how it could be improved. He suggested that if a meeting became non-quorate during the meeting, then the Reserve List could not be invoked. • Councillor Murphy then referred to the matter he raised and believed that if a Member wished to speak at a meeting, they should be required to put it in writing in advance of the meeting, not during. Councillor Pat Davies Moved the Recommendation as set out in the report; Seconded by Councillor Alan Dennison. The Chair then explained that the intention was for the Committee to have the first meeting of the Working Group straight after the meeting of the Committee. Councillor Mike Stoddart also raised the question of a supermajority in regards to suspending standing orders, rather than a simple majority, and wished for this matter to also be discussed at the Working Group. The vote, undertaken by way of a roll call, was carried. For the Motion: Councillors Michelle Bateman, Joshua Beynon, Pat, Davies, Alan Dennison, David Howlett, Paul Miller, Elwyn Morse, Huw Murphy, Mike Stoddart, Aled Thomas, Anji Tinley and Jacob Williams [12] There were no votes against or abstentions. RESOLVED That a Working Group be established consisting of all the Members of the Constitutional Review Committee to look at aspects of the Constitution, to include, but not confined to, the matters set out in the report.
Councillors must say when they have a personal link to something being discussed, such as a job, a property or a family member. A prejudicial interest is one strong enough that the councillor usually leaves the room and takes no part.
