The decisions as the council's minutes record them. A plain-language summary follows once it has been written.
RESOLVED That in accordance with Section 100A(4) of the Local Government Act 1972, the public be excluded from the Meeting for consideration of the current item of business on the grounds that it involves the likely disclosure of exempt information under Schedule 12A to the Act. The Sub-Committee then resumed in open session. DECISION The Sub-Committee has considered carefully all of the representations which have been made, including written representations in the Agenda pack, and the additional representations it has heard during the hearing. The Sub-Committee has made its decision based on the representations it considers relevant to the issues before the Sub-Committee as made by the Applicant for the proposed operation of the premises licence requested. The Sub-Committee notes the withdrawal of the later hour takeaway part of the application. The Sub-Committee has considered and notes the representations by the residents and the Town Council. The Sub-Committee considers that the Applicant has dealt with the concerns raised largely in the withdrawal of the takeaway part of the application. None of the Responsible Authorities has made representations, of which the Sub-Committee takes note. However, the Sub-Committee does consider that the representations that have been made are valid, and that it promotes the licensing objectives in issue to grant the application as now presented but with a slight reduction in the hours of operation. The Sub-Committee considers that the terminal hours of supply of alcohol should be 11pm each day, and that late night refreshment until 12 midnight should not be allowed (effectively 11pm becomes the terminal hour for the supply of refreshment, which is not licensable). The terminal hours of opening of the premises shall be 11:30 pm daily. RESOLVED The Sub-Committee considers that the application as it now stands comprehensively promotes the licensing objectives and the application can be granted as stated.

The Chair welcomed everyone to the meeting and invited the Solicitor to present the procedures for the application noting that the Applicants were present together with two of the Objectors who had made representations. The Lead Licensing Officer then outlined the report regarding an application for a new premises licence for Parkside Diner, Commons Road, Pembroke to the Sub-Committee. In response to a question from the Chair regarding the serving hatch not indicated in the report, the Lead Licensing Officer advised the Sub-Committee that this had been identified following publishing and was not aware of any objections that may now be received. The Chair invited the applicants to present their application to the Sub-Committee. The Applicant highlighted that the premises had been closed for more than five years and that they had taken on the lease on 1 December 2023 with a view to opening by Easter. He noted that the outside grass area had been used and maintained by the leaseholder for the last 30-40 years. He further noted that they would return to the Sub-Committee regarding a variation of licence for the serving hatch. In response to a question from Councillor Tony Wilcox regarding eating in the premises, the Applicant advised that they would anticipate 50 covers but were waiting for confirmation from the Fire Authority. The Chair queried whether breakfast would be eating in or takeaway and the Applicant advised that this would be takeaway only with the sit down menu differing for both Lunch and Evening. In response to a further question from the Chair regarding opening hours, the Applicant confirmed that the application was to run until 00:30hrs with a finish time of 00:00hrs and 30minutes drinking up time. The Applicant confirmed that the area of land outside of the premises was noted as common land on the Land Registry and that it had never been maintained by the Authority. He advised that he intended to have picnic benches sited on the area similar to the previous leaseholder. In response to a question from the Vice-Chair regarding takeaways and litter, the Applicant advised that all takeaway containers will have the diner logo on them and that only plastic drinking glasses would be provided off site. All Off Sales would be in sealed containers. The Chair then invited Councillor Jonathan Grimes to address the Sub-Committee in his capacity as the local Town and County Councillor on behalf of the local residents. Councillor Grimes advised that, with the omission of the serving hatch the situation had changed slightly however, he highlighted concerns of on and off sales until 0200hrs with potential littering and anti-social behaviour. The Chair highlighted that the application for 02:00 had now been removed however, Councillor Grimes noted that the concerns remained. Councillor Grimes further highlighted that Councillor Aaron Carey and himself had been highlighting the issues within Pembroke with a view to increasing the Police presence; however, PCSOs finish at 22:00hrs and they did not want to increase the potential for purchasing alcohol late at night. The Chair then invited the Objector to present his concerns to the Sub-Committee. The Objector advised that their main concerns had been with regard to the late night selling of alcohol via the serving hatch but noted that this had been withdrawn at this stage. In response to a concern from Councillor Vanessa Thomas regarding CCTV, the Applicant advised that they had been recommended to place six cameras but had actually placed 12 with viewing screens behind the bar. The Applicant highlighted that the application was for a restaurant and not a pub as they did not want people just coming in to drink. The Chair then invited the Applicant to sum up before the Sub-Committee moved to its deliberations. The Applicant advised that they were prepared to reduce the hours to 23:00hrs On and Off sales. The Sub-Committee then retired to undertake its consideration of the matter and the representations submitted. Councillors must say when they have a personal link to something being discussed, such as a job, a property or a family member. A prejudicial interest is one strong enough that the councillor usually leaves the room and takes no part.
