A judgment has recently been handed down by the High Court in relation to an application sought by Pembrokeshire County Council for injunctive relief relating to the removal of an authorised agricultural building and associated work at Cwm Farm, Llawhaden. The Council’s application was unsuccessful with the Judge’s decision not to grant the injunctive relief sought by the Council. In his decision the Judge gave weight to the fact that the defendants had made a fourth planning application for the unauthorised development which they claimed sought to address the reasons for previous reason for refusal. Notwithstanding his decision not to grant injunctive relief on this occasion, the Judge identified the other options open to the Council to remedy the breach such as re-prosecution and direct action. Most recently, a costs hearing was held where costs of £19,800 plus officer time were awarded against the Council in respect of the High court trial. The fourth planning application made by the Defendants was submitted to the Local planning Authority in July and deemed valid as of 23rd August 2024. On 4th October 2024, the Council issued a decision to the applicants declining to determine the application under Section 70C of the Town and Country Planning Act (as amended) given that a pre-existing enforcement notice exists which requires the removal of the building. The application has been closed down and no further work will be undertaken. The Local Planning Authority is considering all options to bring about compliance with the terms of a valid Enforcement Notice which requires the removal of the building and associated development.
