The Committee considered a Notice of Motion submitted by Councillor Jacob Williams in the following terms: That the Council evaluates its current procedure for the shortlisting of candidates in relation to the recruitment of posts in which the Senior Staff Committee plays a role. The Chair explained that the Notice of Motion had been submitted prior to the understanding that the Committee would be conducting a review of the Constitution and would therefore withdraw the Notice of Motion on the understanding that the matter would be looked at as part of the review with the Presiding Member to update full Council that the Notice of Motion had been withdrawn. As the Seconder of the Notice of Motion, Councillor Michael Stoddart was in agreement for the Motion to be withdrawn. The Committee noted the withdrawal of the Notice of Motion. RESOLVED That a Working Group of all Constitutional Review Committee Members be established to conduct the task of reviewing the Constitution and report back to the Committee before the March and May Meetings of Council.
The Committee considered a report by the Monitoring Officer on the Review of the Constitution and whether this should be conducted via the full Committee or a working group. The Committee then debated the contents of the report and the key points were highlighted as follows: · The difficulties in the full Committee attending the review were noted by Councillor Paul Miller and a working group was suggested. · Councillors Aaron Carey and Delme Harries supported a working group of all Members. · The Monitoring Officer advised that a Working Group of the whole Committee would overcome any quorum issues; however, the Terms of Reference would need to include an informal quorum to ensure a minimum attendance including at least one Cabinet Member. Councillor Michael Stoddart then Moved that a Working Group be set up containing all Committee Members with regular meetings of the Committee to monitor the progress; Seconded by Councillor Aaron Carey The Chair advised that the new Constitution would be presented to Full Council in May and would come into effect for the Annual General Meeting the following day and that thought needed to be given to this. The Monitoring Officer advised that a Working Group would be convened in the New Year to discuss the programme of work and frequency of meetings. In response to a question from the Chair, the Monitoring Officer advised that many of the 22 Local Authority’s had adopted the new model Constitution noting that a lot of work had already taken place on the Pembrokeshire Model Constitution. The vote, undertaken by way of a roll-call, was carried. The votes were recorded as follows: For the Motion: Councillors Jamie Adams, Aaron Carey, Delme Harries, Paul Miller, Mel Phillips, Michael Stoddart, Aled Thomas and Jacob Williams [8]. There were no votes against the Motion and no abstentions. Councillors must say when they have a personal link to something being discussed, such as a job, a property or a family member. A prejudicial interest is one strong enough that the councillor usually leaves the room and takes no part.
