RESOLVED That the application be APPROVED, subject to the conditions outlined in Section 1.1 of the report of the Director of Community Services.
[Councillor Mark Carter withdrew from the meeting at this juncture]. [Amended by Minute 65 of Committee – 10 January 2023] This application was for Committee consideration as it involved a development that was contrary to the development plan but which was being recommended for approval (paragraph 1(n) of the scheme of delegation). The Planning Officer, Sian Husband, provided an oral update stating that since the publication of the Committee report, Natural Resources Wales (NRW) had provided a consultation response advising that concerns raised could be overcome by the imposition of a condition in respect of submission of a Construction Environment Management Plan (CEMP). The recommendation in the report included reference to a condition requiring submission of a CEMP. NRW also highlighted the need for a Test for Likely Significant Effect (TLSE) in respect of the Special Area for Conservation (SAC). The Council Ecologist had carried out a TLSE which found no significant effect on the SAC. NRW advised that they agree with the recommendations of the submitted Preliminary Ecological Appraisal and advised that the Council Ecologist should consider the need for any further Protected Species Surveys. The Council Ecologist concluded that there was no need for any further protected species surveys. The Committee was advised that due notification had been received from the following interested parties who wished to exercise their right to address the Committee: · Community Council – Mr Peter Horton · Agent – Mr Andrew Vaughan-Harries · Objector – Mr Bevis Musk Following Mr Musk’s address, Councillor Tim Evans requested clarification following a comment that the proposal would be ‘too tall and blocky’ to which Mr Musk made reference to the style outlined within the s106 agreement and stated that he did not think it was unreasonable to expect the Council to continue with the agreement made in 2001 and raised concerns that if the proposal was built higher than the 2001 agreement, it would be his view that it would demonstrate a breach of contract. The Committee proceeded to discuss the application and the key points were noted as follows: · Councillor Jordan Ryan made reference to protected species and queried if there had been any evidence of any on this plot. The Head of Planning advised that the Council’s planning ecologist had been consulted and advised that it was unlikely that the plot would have any negative effect on protected species and added that a further ecological appraisal had been submitted and also did not find any evidence of ecological features on the site. It was added that informatives were also being suggested as a precaution. · In response to a question from Councillor Brian Hall, the Highway Development Control Officer advised that the road leading to the proposed site was not adopted and was currently a private road. · Councillor Jamie Adams requested further information as to whether the Authority had to consider the s106 agreement referred to by the objector, to which the Head of Planning advised that the Authority did have to consider the agreement through the planning process, but drew Members attention to paragraph 5.5 of the Committee report which stated ‘the development be of a similar density and character to the planning permission’ this does not give any indication of height scale parameters, just the density and character and advised that as officers they were content that this complied with that s106 agreement. · The Chair provided information as to why a previous application for seven dwellings was approved under the JUDP. [Councillor Iwan Ward joined the meeting at this juncture] · Councillor Alistair Cameron made reference to Paragraph 6.5 of the Committee report and queried how amendments were considered to be minor or major in nature to which the Chief Planning Officer provided an explanation. · Following questions raised from Councillors Alistair Cameron and Tim Evans, the Highway Development Control Officer provided information on the current size of the road stating that it had been slightly widened as part of previous applications and it was not deemed necessary for any further adjustments to me made to the road at present. It was added that it would be up to the land owner/s to apply for the road to be adopted. Councillor Brian Hall Moved that the application be approved as recommended; Seconded by Councillor Andrew Edwards The Committee then proceeded to the vote, undertaken by way of a roll-call, which was carried. The votes were recorded as follows: For the Motion: Councillors Jamie Adams, Alistair Cameron, Aaron Carey, Andrew Edwards, Tim Evans, Nicola Gwynn, Brian Hall, Jordan Ryan, Tony Wilcox, Jacob Williams and Michael Williams. [Councillor Jamie Adams left the meeting at this juncture] Councillor Pat Davies, Local Member, addressed the Committee to express her support of the application stating that the area needed suitable housing so the development was very welcome to assist with local housing needs and she expressed that she had no concerns regarding the access to the site. Councillor Alistair Cameron queried how accessible this site was in relation to local amenities, to which Councillor Davies stated that the proposed location was highly appropriate and in walking distance to a number of amenities including the doctors surgery, a bus stop and the school. Following highways concerns and questions raised by Councillors Nicola Gwynn, Tim Evans and Alistair Cameron, the Highway Development Control Officer provided information regarding improvements which had been made in the past to the roundabout and also improvement considerations that had been given for pedestrian access as part of this proposal, which had been agreed as part of the application.
