[Having previously declared a personal and prejudicial interest in this item of business, the Chairman, Councillor Jacob Williams withdrew from the meeting]. This application was for Committee consideration as it was for a development contrary to the development plan but which was being recommended for approval. The Committee proceeded to discuss the application and the key points were noted as follows: · Following a question from Councillor Tim Evans regarding changes being made to boundaries as part of the impending Local Development Plan 2 (LDP2), the Chief Planning Officer advised that he was of the opinion that the current application site boundary would remain the same within the LDP2. · Councillor Mark Carter requested clarification as to whether any of the property would fall outside of the settlement boundary or if it would just be the garden of the property. The Chief Planning Officer advised that a large proportion of the dwellings footprints had been proposed outside of the settlement boundary, although this enabled retention of the oak tree, which would likely be made subject to Tree Preservation Order. · Following a question from Councillor Mark Carter, the Chief Planning Officer outlined the details of the required affordable housing financial contribution. · Councillor Tim Evans queried if approving an application for a development partly outside of the settlement boundary would create a precedent for other applications, to which the Chief Planning Officer expressed that all applications were considered on their own merits so was of the opinion that approval of this application would not create a future precedent. · In response to a question from Councillor Tim Evans, the Chief Planning Officer confirmed that the original application had also proposed three dwellings. Councillor Brian Hall Moved that delegated power be granted to the Director of Community Services to approve the application, as recommended; Seconded by Councillor Mark Carter. RESOLVED That the amended application be APPROVED, in accordance with Section 1.1 of the appended 16 March 2022 report of the Director of Community Services.
This application was, during the 16 March 2022 Planning Committee meeting, resolved to be approved subject to delegated authority being granted to the Director of Community Services to resolve matters relating to flood risk and the imposition of the stated planning conditions. Following that meeting, amendments were made to the application, which are subject to this Committee report. The Committee proceeded to discuss the application and the key points were noted as follows: · The Chairman highlighted that there would be 19 fewer parking spaces than originally proposed and queried as to why. Development Manager (Major projects and planning obligations), Mike Simmons, advised that it was to provide a higher number of wider spaces. · Following a question regarding the height of the structure from the Chairman, Development Manager advised that the new structure was proposed to be 3.9m higher than the current structure. · Councillor Mark Carter requested further information as to the improvements which would be made as part of the new structure in comparison to the existing. Development Manager stated that the new structure would offer substantial improvements and provided a number of examples. · Following a question from Councillor Mark Carter, Development Manager confirmed that the new structure would allow access for all types of busses, including those which can’t access the current facility. Councillor Brian Hall Moved that the application be approved as recommended; Seconded by Councillor Mark Carter. · In response to a number of questions raised by the Chairman and Councillor John Cole, Development Manager outlined the proposed pedestrian areas along with the entrance and exit points. · Councillor Andrew Edwards made reference to the anti-social behaviour issues which had been seen at the current multi-storey and queried if increased security measures had been considered for the new proposal. Development Manager advised that security had been a large factor during discussions and advised that the Authority had liaised with the Police and other stakeholders throughout the process to ensure suitable security provision is embedded. · Following a question raised by Councillor Mark Carter regarding disabled facilities, the Development Manager confirmed that bespoke changing and wash facilities had been proposed and formed part of a recommended condition to ensure their delivery. The Committee then proceeded to the vote, undertaken by way of a roll-call, which was carried. RESOLVED That delegated power be granted to the Director of Community Services to APPROVE the application subject to the completion of a S106 Planning Obligation to secure an off-site financial contribution towards the provision of affordable housing and subject to the conditions outlined in Section 1.1 of the report of the Director of Community Services.
This application was presented for Committee consideration as it involved the development of a site contrary to the local development plan (LDP) but which was being recommended for approval. Councillor Nicola Gwynn, Local Member, expressed that her opinion of the development was conflicted as although additional homes within the area would be beneficial, she felt the site did not fit into the character of the area. She added that she did not feel the homes would be as environmentally friendly and sustainable as was needed. The Committee proceeded to discuss the application and the key points were noted as follows: · Following a question from Councillor John Cole, the Chief Planning Officer confirmed that the park homes could not be purchased and used as second homes as the proposed conditions ‘occupancy restricted to over 55’s’ and ‘occupancy as a primary home only’ restricted that. · Councillor Mark Carter made reference to the S106 planning obligation to secure an off-site financial contribution towards the provision of affordable housing, and commented that as the park homes were of less value than a standard home they were already affordable. The Chief Planning Officer informed Members that the park homes would not constitute ‘affordable homes’ as they were still deemed ‘market properties’ and an affordable home would need to be below market value. Councillor Mark Carter Moved that delegated power be granted to the Director of Community Services to approve the application as recommended; Seconded by Councillor Brian Hall. · On receiving a question from Councillor Alistair Cameron regarding the loss of employment land, the Chief Planning Officer provided some background information of a 2006 application and the prior marketing of the site which did not result in any alternative proposals. It was noted that there was another employment allocation site within the LDP for Goodwick area should there be a need in the further for such site, along with the remaining allocation of the industrial estate available. · Councillor Aaron Carey queried whether approving permission for this application would affect future developments for employment purposes on the remaining section of the site to which the Chief Planning Officer advised that as the area was already classified as an industrial area it was unlikely that adverse impact would be seen for future employment land permissions although any future applications would be assessed on their own merits. The Committee then proceeded to the vote, undertaken by way of a roll-call, which was carried. The votes were recorded as follows: For the Motion: Councillors Jamie Adams, Aaron Carey, Mark Carter, Alistair Cameron, John Cole, Andrew Edwards, Tim Evans, Nicola Gwynn, Brian Hall, Jordan Ryan, Michelle Wiggins, Tony Wilcox, Jacob Williams and Michael Williams. [Having previously declared a personal and prejudicial interest in this item of business, Councillor Nicola Gwynn withdrew from the meeting]. This application was for Committee consideration as the application was for an agricultural building with a floorspace of over 1,000sqm (paragraph 1(i) of the scheme of delegation). The Area Team Leader (North), Ceri Jones, provided an oral update stating that since the publication of the Committee report, the Council’s Ecologist had raised no objection to the proposal as it would not result in an increase in the herd size, and the replacement building would reduce the amount of slurry directed to the slurry store resulting in better management of slurry produced. It was therefore considered likely that there would not be an increase in Phosphate entering the SAC catchment, therefore it was considered that there would not be an adverse impact on protected species. Councillor Brian Hall Moved that the application be approved as recommended; Seconded by Councillor Mark Carter. The Committee then proceeded to the vote, undertaken by way of a roll-call, which was carried. The votes were recorded as follows: For the Motion: Councillors Jamie Adams, Aaron Carey, Mark Carter, Alistair Cameron, John Cole, Andrew Edwards, Tim Evans, Brian Hall, Jordan Ryan, Michelle Wiggins, Tony Wilcox, Jacob Williams and Michael Williams. This application was for Committee consideration as it was for an assembly and recreation use (D1 use class) over 500 square metres in floor space (paragraph 1(f) of the scheme of delegation). Following a question from Councillor Andrew Edwards regarding disabled facilities, Local Members, Councillors Brian Hall and Tony Wilcox, commented that the building had disabled access to the ground floor but they were unsure about the second floor. The Planning Officer, Claire Jenkins, advised that she did not have details of upper floor access, but from the floor plan provided it indicated that only a small area of the upper floor was being proposed, which would be used for walkways and storage and the gym, toilets, changing rooms and reception would be on the ground floor. The Chief Planning Officer advised that it was probable that building regulation approval may be required for the building, due to the change of use status, which would ensure accessibility requirements. Councillor Brian Hall Moved that the application be approved as recommended; Seconded by Councillor Tony Wilcox. The Committee then proceeded to the vote, undertaken by way of a roll-call, which was carried.
