This application was presented for Committee consideration as it involved the development of a waste handling facility on a site in excess of 0.5 ha in area (paragraph 1(h) of the scheme of delegation). Planning Officer, Mark Hyde, provided an oral update stating that the report identified the provision of a bus stop adjacent to the site although since publication of the Committee report a technical note had been submitted by the applicant advising that the provision of a bus stop was not feasible. On assessing the evidence, the Head of Infrastructure (Highways) accepted that a bus stop in this location for the proposed type of development would be unlikely to make a meaningful travel choice change and as such, a condition for the provision of a bus stop was not recommended. It was noted that the local highway authority had advised no objection to the proposed development. The Committee was advised that due notification had been received from the following interested parties who wished to exercise their right to address the Committee: · Agent – Mr Ben Withers · Objector – Mr Julian George · Local Member – Councillor Reg Owens Following Mr Withers address, Councillor Mark Carter queried if any other sites were being considered. Mr Withers advised that in the early stages of investigations other sites had been considered, but had proceeded to be discounted. It was clarified that the proposed site was the only site currently deemed suitable. Following a question from Councillor Mark Carter, Mr Withers advised that he was not able to provide a figure on the cost that would be required to bring Winsel site up to standard as that site had been discounted at an early stage due to its unsuitability. Following Mr George’s address, Councillor Tim Evans queried if Mr George was the owner of the local turkey farm and if so, was noise from the farm an issue. Mr George clarified that he was not the owner of the turkey farm, and in general, noise from the farm was not an issue but did fluctuate depending on the direction of prevailing wind. Councillor Jacob Williams sought clarification on the alternative access road which would be used during certain times, to which Mr George referred to the site plan and explained that he was referring to the northern boundary access point. Councillor Reg Owens, Local Member, addressed the Committee to express his disapproval of the site. He provided some history of the site, outlined the impact the refinery had had on neighbouring residents and made reference to a legal agreement that had been made many years ago stating that if the use of the refinery ceased, the land would be returned to agricultural land and suggested that the agreement be given further consideration. Concerns were raised regarding the negative noise and air pollution impact the site would have on neighbouring residents and stated that in his opinion there were alternative sites better suited for the development. The Committee proceeded to discuss the application and the key points were noted as follows: · Councillors Brian Hall, Mark Carter and Jamie Adams acknowledged that the County needed a sufficient waste facility and raised no concerns regarding the proposed location. They did however highlight the importance of installation of acoustic fencing around the site, in advance of the construction phase, to assist with sound retention within the site perimeters and to mitigate noise impact on neighbouring residents. · Following a question from Councillor Brain Hall regarding the construction timetable, the Planning Officer advised that a Construction Environment Management Plan had been proposed as a condition, which would seek to control the days and hours of construction to minimise impact on neighbouring properties and the environment. · Councillor Tim Evans queried what impact the current waste facility in Pembroke Dock had on the local area in terms of noise and odour impact. Councillor Tony Wilcox, Pembroke Dock (Pennar) Ward, commented that the impact from the current site was minimal and did not generate significant volumes of complaints although lorry traffic to the site was commented to be heavy. · Following further discussion regarding the acoustic screening, the Chief Planning Officer provided further information on the matter stating that it would be made up of two elements. He advised that to alleviate the Committee’s concerns, as part of the Construction Environmental Management Plan condition, a requirement for one element of the screening to be introduced at construction stage to assist with noise impact on neighbouring residents could be included. Councillor Marc Carter Moved that delegated authority be granted to the Director of Community Services to approve both applications, as recommended, subject to the withdrawal of the Welsh Ministers’ Holding Direction and with the inclusion that the noise mitigation condition be implemented at the start of the construction phase; Seconded by Councillor Brian Hall. The Committee then proceeded to the vote, undertaken by way of a roll-call, which was carried. The votes were recorded as follows: For the Motion: Councillors Jamie Adams, Mark Carter, John Cole, Alec Cormack, Andrew Edwards, Tim Evans, Nicola Gwynn, Brian Hall, Jordan Ryan, Iwan Ward, Tony Wilcox, Michelle Wiggins, Jacob Williams and Michael Williams [14] There were no votes against or abstentions. RESOLVED (a) 21/1102/PA - That delegated authority be granted to the Director of Community Services to APPROVE the application subject to withdrawal of the Welsh Ministers’ Holding Direction, with the inclusion that the noise mitigation condition be implemented at the start of the construction phase and all conditions outlined in Section 1.1 of the report of the Director of Community Services. (b) 21/1104/PA - That delegated authority be granted to the Director of Community Services to APPROVE the application subject to withdrawal of the Welsh Ministers’ Holding Direction, with the inclusion that the noise mitigation condition be implemented at the start of the construction phase and all conditions outlined in Section 1.2 of the report of the Director of Community Services.

This outline application was presented for Committee consideration as it involved the development of a site in excess of 1.0 ha for residential purposes paragraph 1(a) of the scheme of delegation). The Committee was advised that due notification had been received from the following interested parties who wished to exercise their right to address the Committee: · Agent – Mr Andrew Vaughan-Harries · Objector – Mr Paul Rees · Local Member – Councillor Michael John Following Mr Vaughan-Harries’ address, Councillor Mark Carter requested further information on the formation of the 85% of properties which were not the affordable housing contribution. Mr Vaughan-Harries advised that the application was only an outline application and the developer would make the final decision on the formation of the properties as part of a reserved matters application, although commented that it would likely be a mix of 2, 3 and 4 bedroom properties. Following Mr Rees address, Councillor Mark Carter asked him to clarify if his concerns were that occupiers of the new housing development would park outside the school. Mr Rees advised that his concerns were not with the occupiers of the development parking outside the school but were regarding the additional traffic which would need to access the junction, which during peak school times was already dangerous. Councillor Michael John, Local Member, addressed the Committee to express that he did not object to the principle of planning on the site and had been happy to see the total amount of proposed homes reduce from 75 to 54 with 15% of the homes to be an affordable contribution. Concerns were however raised regarding road safety, the importance of the green buffer belt and the air pollution caused by the Welsh Water treatment works. A request was made that due consideration be given to the Construction Environmental Management Plan to ensure minimal disruption. The Committee proceeded to discuss the application and the key points were noted as follows: · Councillor Nicola Gwynn made reference to the affordable housing contribution and reiterated the Community Council’s comments about those homes being offered to people with a local connection. It was queried whether a covenant could be placed upon those homes to ensure only local residents in need of affordable housing could purchase them. The Chief Planning Officer advised that the Section 106 legal agreement would set out the terms, and would limit the purchase to a buyer currently residing in Pembrokeshire but would not limit it to the Llangwm area. It was noted that a cascade effect for local restriction could not be implemented, as the site was not deemed an exception site. Councillor Brian Hall Moved that the application be approved, as recommended, subject to the completion of a S106 Planning Obligation; Seconded by Councillor Mark Carter. · Following a question from Councillor Tim Evans, the Chief Planning Officer clarified that the outline permission would limit the development to 54 dwellings and any increase to that would require a new full planning application to be submitted. · On receiving a number of questions from the Local Member and Councillor Alec Cormack, the Planning Officer, Mark Hyde, provided further explanation on the affordable contribution requirement and confirmed that 15% of the total amount of units would be affordable units. The Committee then proceeded to the vote, undertaken by way of a roll-call, which was carried. The votes were recorded as follows: For the Motion: Councillors Jamie Adams, Mark Carter, John Cole, Alec Cormack, Andrew Edwards, Tim Evans, Nicola Gwynn, Brian Hall, Jordan Ryan, Iwan Ward, Michelle Wiggins, Tony Wilcox, Jacob Williams and Michael Williams [14] There were no votes against or abstentions. RESOLVED (a) That the application be APPROVED, subject to the completion of a S106 Planning Obligation and conditions outlined in Section 1.1 of the report of the Director of Community Services.
