Decided: The committee noted the applications decided under delegated powers between 8 and 27 May.
RESOLVED The Sub-Committee has carefully considered all of the spoken representations made before it from all parties. The Sub-Committee is tasked with deciding whether the applicant is a fit and proper person to be granted a licence. The Sub-Committee in deciding this has as its primary consideration public safety. The Sub-Committee has decided that it can take into account all matters pertaining to the applicant which are before it. The Sub-Committee are satisfied that it was a caution rather than a conviction which should have been included in the application form. The Sub-Committee is satisfied with the explanation provided by the applicant as to not disclosing this caution in the application process. The Sub-Committee considers that the applicant is a fit and proper/ safe and suitable person to hold the licence and the license is therefore granted.
RESOLVED That in accordance with Section 100A(4) of the Local Government Act 1972, the public be excluded from the Meeting for consideration of the current item of business on the grounds that it involves the likely disclosure of exempt information under Paragraph x of Schedule 12A to the Act. The Sub-Committee then retired to undertake its considerations. The Sub-Committee then resumed in open session and the Chair announced the decision. Moved by Councillor Alun Wills; Seconded by Councillor Tim Evans. The vote, undertaken by way of a show of hands, was carried. RESOLVED In reaching its decision, the Sub-Committee has considered the relevant parts of the Authority’s statement of licensing policy and the statutory guidance, together with all 4 of the licencing objectives. The Sub-Committee has considered this application on its merits and has carefully considered the spoken representations made, both in support of and representations against the application. The application for a new premises licence for the licensed activity of the off sale of alcohol is granted at Lisheens coffee pod situated at Tenby Railway Station This approval is on the provision that the conditions attached to the license are amended to reduce the hours for sale of alcohol to between 11 am – 8pm from Monday - Sunday. This is a variation from the hours that were applied for and the reason for this amendment is that the subcommittee attach significant weight to the representations made by the British transport police as a responsible authority. The subcommittee hope that in reducing the hours for the sale of alcohol it will promote the licensing objectives, in particular the risk to the public and the prevention of crime and disorder, given the statics provided by the transport police today regarding crime. In the interests of public safety and public order the subcommittee had concerns there is no supervision on the station and it is hoped that the reduced hours for the off sale of alcohol will assist in this regard The Sub-Committee consider that there have been no other representations made that are relevant to the licensing objections apart from that of the British Transport Police. The Sub-Committee finds that the application made and clarified by the applicant’s representative comprehensively promotes the licensing objectives and therefore the application can be granted, subject to the amended conditions.
