RESOLVED: The following item is considered to be exempt by virtue of Paragraph(s) 13 of Part 4 of Schedule 12A of the Local Government Act 1972 (as amended). The report contains details that would reveal the identity of an individual and the public interest in withholding the information outweighs the interest in disclosing it.
APPLICATION FOR A PRIVATE HIRE / HACKNEY CARRIAGE (JOINT) DRIVER LICENCE The Licensing Team Manager presented the report to consider and determine an application for a Private Hire /Hackney Carriage (Joint) Driver Licence. The Applicant responded to questions from the Solicitor and Panel and around historic convictions, a recent motoring offence and provided mitigation based on good character and holding a position of responsibility for a significant length of time as well as providing explanation as to the failure to disclose historic convictions on the Application. When the Chair was satisfied that all relevant questions had been raised, she asked that the Applicant and the Licensing Team Leader leave the meeting to enable the panel to reach a decision. 4.1 Determination of the Application The Licensing Team Leader and Applicant were invited to return so that the meeting could be reconvened. 4.2 Decision Members of the Sub-Committee considered all the information including the officer’s report, details of the Applicant’s convictions, the Council’s policy on convictions and the statutory guidance as well as the explanations given by the Applicant. The Members considered that the convictions were of a type relevant to the question of fitness and propriety but the length of time that had passed since the date of the convictions was a significant mitigating factor. The Members also had regard to the Applicant’s explanations as to why the historic convictions had not been disclosed on the Application. Members considered that this was relevant to the question of fitness and propriety but were satisfied with the Applicant’s explanation in this regard. In coming to these decisions, Members had regard to evidence pertaining to the Applicant’s good character over a significant period of time including holding positions of responsibility. Members considered that the recent motoring related conviction could not be considered minor in nature but on the balance of probability were satisfied that the Application is a fit and proper person as under the Local Government (Miscellaneous Provisions) Act 1976 to hold a Hackney Carriage and Private Hire Driver’s Licence and that a licence for a three year period should be granted on the condition that a further DVLA fee paying enquiry is carried out at 12 months of the date of the grant of the licence at the Applicant’s expense. (The meeting started at 10.00 am and ended at 11.15 am)
Councillors must say when they have a personal link to something being discussed, such as a job, a property or a family member. A prejudicial interest is one strong enough that the councillor usually leaves the room and takes no part.
Declarations are read from the minutes once they are published.
