RESOLVED: That the application be deferred, to enable further consideration of the lawful planning status of the application site and whether it benefited from extant planning permission for 15 holiday studios.
An addendum to the report was presented, highlighting the following: • Observations received in a letter from Solicitors in relation to the Committee report. • The receipt of one additional letter of objection. As a consequence of additional information received, Members were advised that the recommendation within the Committee report had been revised to defer the application to a future meeting of the Committee. As a consequence of the revised recommendation to defer consideration of the application, the Local Electoral Division Member, who was registered to speak, sought clarity on when the application would return to Committee. In response, the Development and Building Control Manager advised that a return date could not be confirmed as officers needed time to consider the representation that had been made. All three registered speakers opted not to speak on this occasion, should Members support the revised recommendation. In considering the information presented within the addendum, the Committee RESOLVED: That the application be deferred, to enable further consideration of the lawful planning status of the application site and whether it benefited from extant planning permission for 15 holiday studios.

Further to a site inspection, Ms Gemma Campbell spoke against the application and Miss Sioned Edwards (Agent) spoke in favour. An addendum to the report was presented, highlighting the following: • Further response from Welsh Water and the applicant’s agent regarding surface water drainage and to the possibility of providing alternative connections for the surface and foul water drainage. • Response from Conwy County Borough Councils (CCBC) Waste Manager concerning waste collection. • On the basis of the information currently available in terms of drainage and uncertainty in respect of whether an easement exists to cross the playing fields to provide a connection to the alternative sewer connection, Officers did not consider that the connection to King’s Road would be a matter that could be secured through a Grampian planning condition. • A response from the Highway Authority recommending refusal on the basis of the parking provision and the concerns raised by the Waste Manager. As a result of the additional responses and the need to allow adequate time to resolve the outstanding concerns, the officer recommendation had been amended to be minded to refuse planning permission. Discussion arose regarding the following: • No objection to the proposal having been received from Colwyn Bay Town Council. • The site was considered suitable for development. • Deferring the application, as opposed to refusal, to allow the applicant further time to resolve concerns raised. • Concern was expressed regarding over development, density, current drainage proposals and highway/parking matters. In considering the application, a proposal to defer consideration of the application to allow the applicant opportunity to resolve the concerns raised was proposed and seconded, however, following a vote the proposal was lost and Members resolved to support the officer’s revised recommendation. RESOLVED: (a) That the Planning Committee be minded to refuse planning permission. (b) That the Development and Building Control Manager be authorised to determine the application under delegation. Councillors must say when they have a personal link to something being discussed, such as a job, a property or a family member. A prejudicial interest is one strong enough that the councillor usually leaves the room and takes no part.
