Further to Minute 616(e) 21.12.2023, an addendum to the report was presented, highlighting the following: · Observations from Conwy County Borough Council’s Public Protection Service in respect of noise mitigation measures. · Proposed draft conditions. The applicant’s observations in respect of the proposed conditions were verbally reported. Members’ views were sought as to whether the proposed conditions were acceptable. Particular reference was made to the following: · Condition no. 3 – the amount (percentage) of ground floor floor space, if any, to be retained for retail purposes falling within Class A1 (Shops). · Condition no. 4 – whether any uses within Class A3 (Food and Drink) and/or Class D2 (Assembly and Leisure) should be prohibited from being undertaken within the building. Officers highlighted the importance of imposing the right conditions to control the use of the building, particularly to help protect the amenity of nearby residents. Members reiterated their support for the proposal and contrary to the Officer’s recommendation, were minded to grant conditional planning permission, to include the draft conditions proposed by officers in the addendum, subject to: · The removal of condition no. 3. · Amending condition no. 4 by removing the second paragraph, so that the condition did not place further restrictions on the uses of the building that fell within use classes A1, A3 and D2. · Amending condition no. 5 (removing the final three bullet points), so that only the ground floor of the building was restricted to use as offices, a warehouse and/or storage that is ancillary to the use of the remainder of the building.
