Ms Sioned Griffiths spoke against the application and Councillor Austin Roberts spoke in favour of the application on behalf of Mr Ryan Peers, who was unable to attend the meeting. Further to a site inspection, an addendum to the report was presented, indicating no response from Conwy’s Environment, Road and Facilities service regarding drainage and flood risk. In considering the application, Members made reference to the following: · Concern regarding flooding, drainage and the septic tank. · Insufficient parking provision due to limited space at the front of the property and no land surrounding the building for off road parking. · The site was within close proximity to a highway, which was often frequented by heavy agricultural machinery. · There was some concern regarding the design and safety aspects. · There was a need for affordable homes in the area for local people. · Concern was expressed that the applicant would not reside in the property and that the dwellings could become second homes. · The investment and retention of a building with architectural character, was praised. The Development and Building Control Manager made reference to similarities to that of another application and advised Members to remain consistent in their decision making process. Whilst some Members were supportive of refusing conditional planning permission on the grounds of parking, drainage and the possibility of the dwellings becoming second homes, the majority of Members supported the application. RESOLVED: (a) That the Planning Committee be minded to grant conditional planning permission. (b) That the Development and Building Control manager be authorised to determine the application under delegation.

Mr Wynne Evans spoke against the application on behalf of the Rhos Park Bowling Club and the Colwyn Bay Cricket Club and Councillor Chris Brockley (applicant) spoke in favour of the application. In the interest of transparency, Councillor Brockley advised that he was speaking in his capacity as the applicant and not as a County Councillor. Accordingly, Councillor Brockley left the meeting following his address to the Committee. An addendum to the report was presented, highlighting the following: • The applicant had been given the opportunity to submit a more detailed site plan, in order to establish whether there would be an impact on surface water sewers and two manhole covers in the vicinity of the proposed portacabin. Officers advised that, should Members be minded to grant planning permission, they should condition the requirement that the applicant submits a more detailed site plan for approval, in order to ensure that the development does not affect access to Welsh Water’s assets. In considering the application, Members made reference to the following: • The success of similar projects in other parts of the County. • The need for such a provision. • The need to keep Community Centres open to support communities. • Young people having access to sports clubs had proven to be beneficial. As a result of the information provided, Members were supportive of a revised recommendation to that within the Committee. Mrs Angela Oakes spoke against the application and Mr Peter Lloyd (Agent) spoke in favour. Further to a site inspection, an addendum to the report was presented, highlighting the following: • The receipt of a further 4 objections (12 in total). • Officers advised that the proposal was for a net increase of 2 holiday lodges and therefore, fairly modest in scale in comparison with other holiday parks in the area. • At the request of the Council’s Ecologist, a badger expert Mr Malcolm Ingham had been consulted and his advice highlighted. Following further monitoring, the Council’s Ecologist was clearly of the view that the survey had been carried out robustly, and that the impact of the development on badgers could be managed to an acceptable level. Furthermore, NRW’s guidance ‘Badgers – A Guide for Developers’ advised that licence applications should include proposals showing how it would be ensured that there were no badgers occupying setts that needed to be damaged or destroyed. Officers were therefore of the opinion that, in the event that there were potential badger welfare issues, they would be addressed satisfactorily at the licencing stage. · The Community Council reiterated their concerns in terms of deferring the application pending a further badger report by Mr Ingham. In response to the Community Council’s request, it was noted that the Council’s Ecologist had advised that she was now satisfied that the further survey work carried was of an appropriate standard. The Principal Planning officer verbally referred to a further response from the Council’s Ecologist, which explained she was not making an objection to the proposal. In considering the application, Members made reference to the following: • Tourism generation. • Badger and wildlife concerns, mitigation measures and licensing controls (NRW). In response, the Development and Building Control Manager informed Members that, should any damage occur to the badger sett, in the absence of an appropriate licence, it would be a matter for the NWP Wildlife Crime Officer to investigate. RESOLVED: (a) That the Planning Committee be minded to grant conditional planning permission. (b) That the Building and Development Control Manager be authorised to determine the application under delegation.

Following the submission and consideration of the Transport Technical Note, the North Wales Fire Service and Rescue Service confirmed that the document sufficiently addressed the concerns relating to access and offered no further comments. • The receipt of additional information regarding the report of the Structural Engineer. Councillors must say when they have a personal link to something being discussed, such as a job, a property or a family member. A prejudicial interest is one strong enough that the councillor usually leaves the room and takes no part.
