RESOLVED: That the forward work programme for the Economy and Place Overview and Scrutiny Committee, together with the combined FWP be approved, subject to the following: - That the Replacement Local Development Plan timetable and delivery agreement be presented directly to Cabinet and the meeting of the Economy and Place Overview and Scrutiny Committee scheduled for 23 August 2023 be cancelled. - That an additional meeting of the Economy and Place Overview and Scrutiny Committee be scheduled for the end of September/beginning of October 2023.
The Scrutiny and Committee Services Officer presented the Economy and Place Overview and Scrutiny Committee Forward Work Programme (FWP), together with the combined FWP. Members were advised of the following: · Three reports relating to the Replacement Local Development Plan (RLDP) process scheduled for the August meeting had been deferred, as Officers were awaiting information from external sources. · The only report that would be ready was the RLDP timetable and delivery agreement, therefore, the Committee was asked whether this warranted scrutiny or could it go directly to Cabinet for approval. It was agreed that as Welsh Government had agreed the timetable, that the report should go directly to Cabinet for endorsement and the meeting scheduled for 23 August 2023 be cancelled. · As there was a number of RLDP reports that needed rescheduling, as well as a report on proposed Dog Control Orders, an additional meeting would be arranged for the end of September or the beginning of October 2023, as the agenda for the meeting scheduled for 27 September 2023 was already congested. In considering the FWP, the following was raised: · Reference was made to the report relating to the Sustainability of Public Conveniences, which was scheduled for 27 September 2023 and whether the Community Toilet Scheme was still in operation. The Scrutiny and Committee Services Officer would contact Environment, Roads and Facilities and circulate the response to the Committee. · Reference was also made to data that was being collated in relation to the use of public conveniences and whether this should be included within the report.

The Cabinet Member for Housing and Regulatory Services, together with the Senior Planning Officer presented a background paper that would accompany the Replacement Local Development Plan (RLDP), which assessed the social care needs (land use only), updated the policy approach for care homes, and made recommendations for linked policy areas. In considering the report, the following was noted: · The implications for Registered Social Landlords and private developers of the policy approaches that required new developments to be more age and disability friendly. · The approach to working towards ‘Net Zero Carbon’ would be considered through other policies, which would be presented through democracy accordingly. · The shortage of care homes in some areas of the County Borough and recent closures in the east of the County. RECOMMENDED TO CABINET (a) That the key findings and recommendations of the Replacement Local Development Plan and Social Care background paper be noted, recognising the implications for policy changes. (b) That the Replacement Local Development Plan and Social Care background paper be approved as part of the evidence base and the proposed policy approach. (c) That delegated authority be given to the Head of Regulatory and Housing to make minor changes to the Replacement Local Development Plan and Social Care background paper, following consultation.
The Cabinet Member for Housing and Regulatory Services, together with the Senior Planning Officer presented a report, which included further research in respect to the new policy approach for Houses in Multiple Occupation (HMOs) for the Replacement Local Development Plan following the Cabinet decision on 10 January 2023. In considering the report, the following was noted: · The changes to the policy approach to include monitoring indicators, and that a requirement for a management plan for large HMOs and an upper limit on occupancy numbers to be put on large HMOs be managed by Housing Enforcement and the HMO Licensing system. · Licensing enforcement would be undertaken by Licensing Officers not the Licensing Committee. However, if changes were required to the HMO Licensing Scheme, then these could be brought to Scrutiny and Cabinet for consideration. · The policies for Shared Accommodation and Holiday Accommodation Zones would still apply to the use of hospitality accommodation as temporary housing accommodation. · The SARTH allocations policy prevented HMOs being used to house families or vulnerable people under the age of 35 who were on the affordable housing registers. · The health and wellbeing benefits of having self-contained accommodation, particularly following the pandemic; however, it was acknowledged that such accommodation was not affordable for all. RECOMMENDED TO CABINET a) That the monitoring indicator to monitor the concentration of Houses in Multiple Occupation be approved as outlined in Appendix 1 of the report. b) That the limit on the number of occupiers be managed via housing enforcement and licensing, and not planning policy. c) That the requirement of a management plan be managed via housing enforcement and licensing, and not planning policy. d) That the key findings and recommendations of the Houses in Multiple Occupation further research paper be noted recognising the implications for policy changes and potential risks for the Replacement Local Development Plan. e) That the Houses in Multiple Occupation Study be approved as part of the Replacement Local Development Plan evidence base and the proposed new policy. f) That delegated authority be given to the Head of Regulatory and Housing to make minor changes to the Houses in Multiple Occupation Study and Policy, following consultation.
The Cabinet Member for Housing and Regulatory Services, together with the Senior Planning Officer presented the Llandudno Holiday Accommodation Study, which reviewed the policy in respect of the appropriate level of serviced accommodation for tourism in Llandudno (Policy TOU/3 Holiday Accommodation Zone (HAZ)). In scrutinising the report, the following was noted: · Supplementary Planning Guidance (SPG) would be produced following adoption of the policy in the Replacement Local Development Plan to provide a clear supporting framework. · The policy proposed no loss of serviced accommodation within the reduced HAZ boundary; provided support for new, improved or conversions to serviced accommodation within Llandudno; and there was a presumption against the loss of service accommodation outside the HAZ subject to strict criteria. · The approach to temporary housing accommodation being brought back to use as serviced holiday accommodation. · Houses in Multiple Occupation (HMOs) would not be allowed in a HAZ. · Supporting text would be included within the policy as to the definition of serviced accommodation. RECOMMENDED TO CABINET a) That the key findings and recommendations of the Llandudno Holiday Accommodation Zone Study be approved recognising the implications for policy changes and that the draft policy changes in the Replacement Local Development Plan be agreed. b) That the Llandudno Holiday Accommodation Zone Study be approved as part of the Replacement Local Development Plan evidence base. c) That delegated authority be given to the Head of Regulatory and Housing to make minor changes to the Llandudno Holiday Accommodation Zone Study, following consultation.
Councillors must say when they have a personal link to something being discussed, such as a job, a property or a family member. A prejudicial interest is one strong enough that the councillor usually leaves the room and takes no part.
