RESOLVED- That the minutes of the meeting of the Planning Committee held on 14 December 2022 be approved and signed as a correct record, subject to the above amendment.
The minutes of the meeting of the Planning Committee held on 14 December, 2022 were submitted for approval. In relation to Minute 514 (b), reference should have been made to Members being advised that the location plan within the Committee report was incorrect and that the correct location plan was appended to the Addendum to the report. RESOLVED- That the minutes of the meeting of the Planning Committee held on 14 December 2022 be approved and signed as a correct record, subject to the above amendment.
Members’ views were sought as to whether to reaffirm the Planning Committee resolution (10.08.2022) to be ‘minded to refuse conditional planning permission’. An addendum to the report was presented which highlighted the receipt of two statutory declarations relating to works involving the raising of the garden and the framework for the construction of an outbuilding. The Council’s Solicitor advised on the appeal process and reminded Members that should they reaffirm the Planning Committee resolution to be minded to refuse conditional planning permission, contrary to Officer recommendation, there would be a requirement to substantiate refusal. The Planning Officers reiterated their reasons to be minded to grant conditional planning permission and made reference to the size of an outbuilding that could be built utilising permitted development rights. Some Members remained supportive of affirming the previous resolution to be minded to refuse planning permission due to the retrospective nature of the application, the development having an adverse impact on the amenity of the area and the structure being contrary to Local Development Plan (LDP) Policy. However, following further consideration of the application, a proposal to be minded to grant conditional planning permission, as per the Officers recommendation was proposed and seconded. Another proposal was made to defer consideration of the application, pending further clarity in relation to the height of the land, terraced area and decking, but was not seconded. Following a vote and contrary to the previous recommendation of the Committee, it was RESOVED: (a) That the Planning Committee be minded to grant conditional planning permission. (b) That the Development and Building Control Manager be authorised to determine the application under delegation.

Members’ views were sought as to whether to reaffirm the Planning Committee resolution (14.12.2022) to be ‘minded to grant conditional planning permission’. The reason given by Members to be minded to grant conditional planning permission was that the proposed dwelling would enable the applicant to relocate from Cardiff and return to her home area, along with her family, to work locally and support the Welsh language. An addendum to the report was presented, highlighting the following: The Principal Planning Officer advised that the application had been advertised in the press as being contrary to the Local Development Plan, and that the statutory publicity period would expire on 11 January, 2023. Officers requested delegated authority to give consideration to any representations that may be received before the end of the consultation period. Whilst the majority of Members were supportive of the resolution of the previous Planning Committee, a proposal to refuse planning permission, as per the Officers recommendation, was proposed due to the application being contrary to the requirements of the Local Development Plan and unfair to local residents, who already lived in the area, however, the proposal was not seconded. The Council’s Solicitor advised Members to consider each planning application on its own merits and consider material planning considerations. Contrary to the Officer’s recommendation, Members proposed to reaffirm the previous resolution. RESOLVED: (a) That the Planning Committee be minded to grant conditional planning permission. (b) That the Development and Building Control Manager be authorised to give consideration to any representations that may be received during the statutory consultation period, and to determine the application under delegation. (Note: Councillor Austin Roberts declared a personal and prejudicial interest in the above item as he knows the family and, as a consequence, withdrew from the meeting whilst the matter was being discussed.)

RESOLVED: (a) That the Planning Committee be minded to grant conditional planning permission, subject to a planning condition requiring replacement Cordyline Autralis trees (minimum 2m height) in the landscaping scheme and the Welsh Ministers withdrawal of the holding direction. (b) That the Development and Building Control Manager be authorised to determine the application under delegation, subject to the Welsh Ministers withdrawing the holding direction.
Further to a site visit, Ms Debbie Wareham spoke against the application and Mr Andrew Kelly (Agent) spoke in favour. An addendum to the report was presented, highlighting the following: • Members were advised that the Welsh Ministers (WMs) had issued a holding direction as they had been asked to call-in the application. As a consequence, the WMs would consider whether or not the application should be called-in for their determination. Members were advised that the direction prevented the Local Planning Authority (LPA) only from granting planning permission, it did not prevent the LPA from continuing to process or consult on the application. Neither did it prevent the LPA from refusing planning permission. The Committee could still proceed to consider the application, but if the Committee was minded to grant conditional planning permission, the LPA was prohibited from determining the application until the WMs withdrew the holding direction or called-in the application. • In addition, observations received from the Conwy County Borough Council’s (CCBC) Tree Officer were highlighted. Having considered the application, Members were supportive of the proposal and considered it an enhancement to what was already a very successful tourist attraction, subject to the inclusion of a planning condition to include replacement Cordyline Autralis trees (minimum 2m height) in the landscaping scheme.

(Note: Councillor Austin Roberts declared a non-prejudicial interest in the above application and was therefore able to stay in the meeting and vote).
Further to a site visit, an addendum to the report was presented detailing the following additional information: • Applicant response to the Committee report and the submission of an amended site location plan, to include site access improvements works, as requested by Highways. • The receipt of additional public representation. • Consultee update from Conwy County Borough Council (CCBC) – Highways. In light of the further information received, Planning Officers, together with the Council’s Solicitor present in the meeting, strongly advised that consideration of the application be deferred to allow time for the applicant to amend the proposed site layout plan and omit or relocate the 3 no. glamping units to safeguard the setting of the listed building Eirianws Cottage and Eirianws Farm, and to address the improvement to the existing access recommended by CCBC Highways. Members were supportive of a deferral and as a consequence, Mr Alexander George, who was registered to speak against the application, would be given the opportunity to speak when the application was next considered by the Committee. RESOLVED: That consideration of the application be deferred, pending the submission of amended site layout plans to omit or relocate the 3 no. glamping units to safeguard the setting of the listed building Eirianws Cottage and Eirianws Farm, and to address the improvement to the existing access recommended by Conwy County Borough Council Highways Department. Councillors must say when they have a personal link to something being discussed, such as a job, a property or a family member. A prejudicial interest is one strong enough that the councillor usually leaves the room and takes no part.
