The Cabinet Member considered a report on the Regulation of Investigatory Powers Act. This report was intended to allow elected members oversight in respect of the Council’s covert surveillance activity. The report gave an update on the level of covert surveillance activity by the Council and was intended to review the procedures that have been adopted in respect of this activity. It was noted in the report that the Council did not authorise the conduct of any covert surveillance in 2025 and indeed has not done so since 2015. There have been no reports of the Council conducting unauthorised covert surveillance during this period. The Legal Services Manager advised that the lack of covert surveillance in this period was in large part due to the ability of departments to gather intelligence without the need for covert surveillance. It was noted that the Legal Services Manager had received refresher training on the Regulation of Investigatory Powers Act from an external provider. He then delivered training sessions for enforcement officers across departments, Heads of Service who can authorise covert surveillance, and the Chief Executive, who is the only person who can authorise certain types of covert surveillance. The Cabinet Member was also informed that queries about covert surveillance were logged so the Legal Services Manager could report on the level of queries that didn’t lead to official requests for authorisation. There were three such queries in the last year. RESOLVED to 3.1 note the level of covert surveillance activity undertaken by the Council in 2025 3.2 approve the Councils RIPA procedures for 2026
Councillors must say when they have a personal link to something being discussed, such as a job, a property or a family member. A prejudicial interest is one strong enough that the councillor usually leaves the room and takes no part.
Declarations are read from the minutes once they are published.
