Decision as recorded
RESOLVED: Pursuant to this Committee’s delegated powers the following development management applications be determined in accordance with the recommendation set out in the reports of the Director of Planning, Transport and Environment, subject to any further amendments as detailed below and notification be given of the decisions in accordance with Section 70 of the Town and Country Planning Act 1990 or Section 74 of the Planning (Listed Building & Conservation) Act 1990. APPLICATIONS REFUSED: 5a. 26/00051/FUL – PLASNEWYDD Rainbow Bargain Ltd, Bangor Street, Roath, Cardiff, CF24 3LQ Repair, alteration, and extension, together with external landscaping and change-of use to a flexible mixed-use development. Refusal by reason of the height and proximity of the proposed northern extension to the side windows serving the adjacent property (which has consent for residential use), it is considered that the development would have an unacceptably overbearing and unneighbourly impact on the amenities of the adjacent occupants, contrary to Policy KP5 of the adopted Local Development Plan 2016. (Cllr Wong left his seat as a member of the Committee during this item in accordance with his prejudicial interest). 5c. 26/01181/FUL – FAIRWATER Land Adjacent To 1 Whitland Close, Fairwater, Cardiff, CF5 3NB Construction of a bungalow. Refusal for the following reasons: 1. The proposed development, by reason of its siting, design, scale, massing and relationship with the established pattern of development, would constitute an overdevelopment of a constrained front/side garden plot. The detached, standalone bungalow would fail to maintain the spacious open frontage, established spacing between buildings, prevailing building line and consistent pattern of two-storey terraced and semi-detached development that define Whitland Close. As such, the proposal would appear as an incongruous and visually prominent form of development, would fail to respond positively to the character and context of the surrounding area, and would result in an unacceptable town-cramming effect. The proposal would therefore be contrary to Planning Policy Wales, Policy KP5 of the Cardiff Local Development Plan 2006-2026 and the Council's Infill Sites Supplementary Planning Guidance. 2. The proposed dwelling would be sited within the protection zone of a public sewer/water main and insufficient information has been provided to demonstrate that the development could be undertaken without prejudice to the operation, maintenance, protection and future access requirements of this infrastructure. The proposal therefore fails to demonstrate an acceptable water-sensitive design solution, contrary to Policy EN10 of the Cardiff Local Development Plan 2006-2026. 3. The application is inadequately supported by information to demonstrate that the proposed development would maintain and enhance biodiversity, deliver a net benefit for biodiversity or provide appropriate green infrastructure mitigation and enhancement, particularly having regard to the loss of existing garden vegetation, including shrubs and hedging. The proposal would therefore fail to demonstrate compliance with Planning Policy Wales, Future Wales Policy 9 and Policies KP15, KP16, EN6, EN7 and EN8 of the Cardiff Local Development Plan 2006-2026. APPLICATION GRANTED: 5b. 26/00052/LBC – PLASNEWYDD Rainbow Bargain Ltd, Bangor Street, Roath, Cardiff, CF24 3LQ (Listed Building Consent granted subject to conditions, and subject to an advisory note that emphasises that planning permission has not been granted for the external alterations and extensions, and therefore no such works are authorised until and unless planning permission has been granted.)

RESOLVED: To note the Appeals Report for the period 10th April – 20th August.
Cllr Hunt queried the number of appeals allowed in the period shown. Officers clarified that around a third of appeals were generally allowed nationally, and two-thirds dismissed, and over the course of the year things tended to average out. Appeal decisions were also material considerations in determining future applications. RESOLVED: To note the Appeals Report for the period 10th April – 20th August.

Councillors must say when they have a personal link to something being discussed, such as a job, a property or a family member. A prejudicial interest is one strong enough that the councillor usually leaves the room and takes no part.
