Present: Applicants: Matthew Phipps (Solicitor) Jake Lewis (Owner) Officers: Daniel Cook (Licensing) Amanda Jones (Legal Services) Graham Porter (Democratic Services) Chris Kelsey (Democratic Services) The Application An application for the grant of a Premises Licence had been received from Fed Restaurant Group Ltd in respect of Fed Restaurant Group Ltd, 72A Llandaff Road, Pontcanna, Cardiff, CF11 9NL. The applicant has applied for the following: • In respect of the following licensable activities: (i) The sale of alcohol for consumption on and off the premises. (ii) The provision of late night refreshment (indoors). • Description of Premises (as stated by applicant): “Bar and Restaurant”. • Unless otherwise indicated the premises may be open to the public during the following hours and for any hours consequential to the non-standard timings: Sunday to Wednesday: 09:00 to 23:00 hours Thursday to Saturday: 09:00 to 00:00 hours • To provide licensable activities during the following hours: (i) The sale of alcohol for consumption on and off the premises: Sunday to Wednesday: 09:00 to 23:00 hours Thursday to Saturday: 09:00 to 23:30 hours (ii) The provision of late night refreshment (indoors): Thursday to Saturday: 23:00 to 23:30 hours Applicant Representation Representing the applicant, Mr Phipps informed the Committee that Mr Lewis had opened the Sonder Bar and Bistro restaurant at 72 Llandaff Road 8 months ago and it had been very successful. The current premises, previously a fruit juice café, had since become vacant and Mr Lewis wished to take over the premises, subject to the grant of a premises licence. Mr Phipps advised the Committee that the applicant’s intention would not be open the new premises to the public probably before 5:00pm. It would serve as an adjunct to the existing Sonder Bar and Bistro, the kitchen assisting in providing more space for food preparation. The applicant would want to serve and sell charcuterie and small plates in the evening, and also have a bar. The premises would have a capacity for 36 people in a seated arrangement. The premises are narrow and do not lend themselves to being a restaurant but are suitable for the serving of small plates and drinks, probably wine in the main. The food and drink offer is premium priced. Mr Phipps told the Committee that the hours requested were not excessive, with alcohol service only until 23:00 Sunday to Wednesday and 23:30 Thursday to Saturday. Turning to other parties’ representations, Mr Phipps told the Committee there had been one representation received in objection from a resident. With respect he could not agree with the objection that this was a late night venue as it had an absolute closing time on late nights (Thursday to Saturday) of 00:00 hours. The objection made reference to intermittent noise concerns, probably in relation to people leaving Sonder Bar and Bistro. Mr Phipps told the Committee that while there may have been the odd occasion when a customer was loud on leaving and walking to their car, it would be disproportionate to say that this would undermine the licensing objectives. Issues around parking are not matters for consideration under the Licensing Act 2003. Mr Phipps referred the Committee’s attention to the schedules of conditions agreed with South Wales Police and with the Pollution Control team respectively. Members had no questions. Summing Up Summing up, Mr Phipps reminded the Committee that any residual concerns or issues that arose could be addressed through the review process. Decision RESOLVED – That the Sub Committee, having considered the application on its individual merits, the committee papers, statutory guidance made under section 182 of the Licensing Act 2003 and the Council’s Statement of Licensing Policy, submissions made by the applicant and all other parties, and the oral evidence given by the applicant during the hearing in its determination of the matter, GRANTED the application subject to the agreed conditions with South Wales Police and Environmental Health / Pollution Control.
